BecomeAfish Participation & Liability Waiver

1. Acknowledgement of Inherent Risk

I understand and acknowledge that swimming, aquatic activities, and water-based instruction involve inherent risks, including but not limited to: drowning or near-drowning, spinal or head injuries from pool entry or pool edges, lacerations or abrasions from pool surfaces and equipment, physical exertion–related illness or injury, and exposure to waterborne pathogens. These risks exist regardless of the care taken by BecomeAfish instructors.

2. Voluntary Participation

I confirm that participation in BecomeAfish lessons and programs is entirely voluntary. I am enrolling on behalf of myself and/or the swimmer(s) named in this booking, and I do so with full knowledge of the risks described in this waiver.

3. Parent/Guardian Consent for Minor Participants

Where the participant is under 19 years of age (the age of majority in British Columbia), the person signing this waiver confirms that they are the parent or legal guardian of the participant and have the legal authority to consent on their behalf. The parent or guardian agrees to all terms of this waiver on behalf of the minor participant and accepts full responsibility for the minor's participation in BecomeAfish programs. The parent or guardian also consents to emergency medical treatment being administered to the minor in the event they cannot be reached. This consent is given in accordance with the Infants Act (RSBC 1996, c. 223) and applies for the duration of the minor's enrolment with BecomeAfish.

4. Release and Waiver of Liability

In consideration of being permitted to participate in BecomeAfish programs, I, for myself and on behalf of my heirs, personal representatives, and assigns, hereby release, waive, discharge, and covenant not to sue BecomeAfish, its founder, instructors, employees, agents, and contractors (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by the participant, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by the laws of British Columbia, Canada.

5. Medical Disclosure

I agree to disclose, prior to the first lesson, any and all medical conditions, physical limitations, allergies, medications, prior injuries, or other health considerations that may affect the swimmer's safe participation in aquatic activities. I understand that BecomeAfish uses this information solely to protect the safety of the swimmer and the instructor. I acknowledge that failure to disclose known conditions releases BecomeAfish from any liability arising from undisclosed conditions.

6. Instructor Authority

I agree that BecomeAfish instructors have full authority to pause, modify, or terminate a lesson at any time if they determine that continuing would pose a risk to the swimmer, themselves, or others. I agree to follow all reasonable instructions from the instructor before, during, and after each lesson.

7. Photography & Media

I understand that no photos or video recordings of lessons will be shared publicly without explicit written consent. Any progress media shared through the BecomeAfish platform is visible only to the account holder and assigned instructor unless expressly authorized otherwise.

8. Emergency Medical Treatment

In the event of an emergency, I authorize BecomeAfish instructors to take any reasonable action they deem necessary to protect the welfare of the swimmer, including calling emergency services (911) and administering first aid within the scope of the instructor's certifications. I agree to be responsible for any costs associated with emergency medical treatment.

9. Cancellation & Conduct

I understand that BecomeAfish reserves the right to cancel or suspend lessons without refund in cases of repeated last-minute cancellations without notice, abusive, threatening, or disrespectful behaviour toward instructors or staff, or misrepresentation of medical or safety information at the time of enrolment.

10. Governing Law

This waiver shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada. Any disputes arising out of this waiver or participation in BecomeAfish programs shall be subject to the exclusive jurisdiction of the courts of British Columbia.

11. Severability

If any provision of this waiver is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
